Basic Qualification •C4 – Counsel - JD with a minimum of 4+ years of Federal Acquisition Regulations and US Government contracting experience in a law firm, corporate law department or U.S. government agency legal department required. Contract negotiation and/or administration experience required.
•C3 – Senior Counsel - JD with a minimum of 7+ years Federal Acquisition Regulations and US Government contracting experience in a law firm, corporate law department or U.S. government agency legal department required. Contract negotiation and/or administration experience required. Details This role primarily serves as the primary legal advisor for matters relating GSK Biologicals’ contracts with the US Dept. of Health and Human Services (HHS) focused on important areas of flu vaccine development, including contracts for (1) the development of pandemic flu vaccines (currently avian and swine flu vaccines), (2) the purchase for stockpiling purposes of pandemic flu vaccines (currently avian and swine flu vaccines), and the development of cell culture technology relating to the manufacture of flu vaccines. In addition, the role provides contract management, and business support relating to those contracts. Depending on the qualifications of the individual filling the role, the role will also serve as the primary legal support for (1) negotiations of contracts relating to pharmaceutical products with managed care plans, hospital purchasing groups, physician provider groups or other customers of the US Pharmaceuticals business, (2) negotiations of certain R&D related agreements (e.g., clinical trial agreements, collaboration agreements, materials transfer agreements, etc.) for certain specified Biologicals clients and other support for Bilogicals’ R&D activities in North America, or (3) certain specified sales and marketing activities in North America.
The position reports to the head of North America Biologicals Legal Operations. The position will be based at Franklin Plaza (US) and will require periodic travel to Montreal (Laval) and occasional travel to Rixensart (Belgium) and Washington DC. The role will be an important member of the Biologicals HHS Contract Management cross-functional leadership team that is responsible for management of the HHS contracts and will interact with senir management of Biologicals with respect to the HHS contracts.
Specific Key Responsibilities:
•Primary GSK legal support for GSK Biologicals’ HHS Contracts, including advice on FAR regulations, negotiation of new agreements (including advice in connection with responding to RFPs) or amendments to existing agreements, advice in connection with disputes or potential disputes under those agreements and other matters relating to these contracts requiring legal advice.
•Primary GSK spokesperson and interface with HHS for all contract related communications with the Government contracting officers, with responsibility to engage other GSK stakeholders in those discussions as appropriate.
•Overall responsibility for subcontracts related to the HHS Contracts. This includes responsibility for the preparation and negotiation of all HHS Contract-related subcontracts while ensuring that all mandated FAR and contract-mandated “flow-down provisions” are included in the subcontracts and interfacing with HHS Contracting Officers to obtain approval, as necessary, for all HHS Contract-related subcontractors.
•Responsible, in collaboration with the North America Biologicals Compliance Officer, for SOP development and training of personnel involved in the HHS contracts on document retention and preservation and administrative requirements of the contracts.
•Ensures compliance with GSK and FAR requirements in terms of processes and controls.
•Work with the HCMT to prepare for and respond to periodic audits by Global Internal Audit (GIA) or potential audits by the US Government. |

Preferred Qualification •Experience with negotiating contracts for the provision of healthcare goods and/or services with managed care organizations or hospital, physician or other provider groups, experience in support for pharmaceuticals sales and marketing or R&D activities, or other experience in pharmaceuticals preferred. •Outstanding oral and written communication skills. •Excellent analytical and negotiation skills. •Attention to detail and excellent organization skills. •Ability to work and problem solve independently. •Ability to effectively and confidently interface with internal executive level management. •Ability to handle a substantial workload and multiple complex problems and competing priorities. •Some travel may be required •Experience operating in a Global environment. •Team player, able to work with tight deadlines. |
